  • Acting for the successful defendant/part 20 claimant in RPS Planning and Development Ltd v Follett Property Holdings Ltd [2011] All ER (D) 197 (Jun): refusal to pay professional fees for negligent planning advice and counterclaim for losses arising.
  • Acting for the successful claimant in Accord Housing Association Ltd v Concept Development Solutions Ltd [2010] Ch: construction of overage provision in a development agreement.
  • Acting for the successful defendant at first instance and in the Court of Appeal in Fitzroy House Epworth Street (No.1) Ltd & Another v The Financial Times Limited [2006] EWCA Civ 329: meaning of ‘material compliance’ with the tenant’s covenants when giving notice to break a lease.
  • Acting for the successful claimant in Midtown Ltd v City of London Real Property Company Ltd [2005] EWHC 33 (Ch): interference with rights to natural light in an office building.

Profile:

Darren has been a property litigator specialising in commercial & residential property dispute resolution for over 20 years. Darren also has a wealth of experience advising on arbitrations, expert determinations and in resolving disputes by mediation.


After training and qualifying as a commercial litigation solicitor at Kent Jones & Done (Stoke on Trent), Darren was head-hunted by the leading Birmingham firm Martineau Johnson (now Shakespeare Martineau) and given the opportunity to specialise exclusively in contentious property work. Darren then moved to Wragge & Co (now Gowling WLG) where he spent 6 enjoyable years as an associate in the property litigation team, before moving to the Birmingham office of national law firm Shoosmiths as a partner. Darren’s most recent role prior to joining Paddle & Cocks LLP was as head of the litigation team at niche commercial firm Bridgehouse Partners, where he undertook a wide range of commercial and property litigation work both within the UK and internationally.


Darren is experienced in advising on development issues, all aspects of property management, dealing with lease renewals (particularly those involving opposition on redevelopment grounds), break notices (including complex conditional break options), easements, rent reviews, restrictive covenants, rights to light, dilapidations and service charge disputes. He has direct experience of appearing at public inquiries, judicial review in the planning context and compulsory purchase.


Darren also advises individuals in neighbour disputes, residential possession actions, leasehold enfranchisement and debt claims for unpaid rent.


Darren is also an experienced commercial litigation solicitor with a particular interest in insolvency.
